İstanbul 5. Ağır Ceza Mahkemesinin kararında, hakkındaki iddianamenin kabul edildiği İstanbul 43. Asliye Ceza Mahkemesi dosyasının tutuklu sanığı Şansal’ın avukatı Efkan Bolaç’ın, müvekkilinin tutukluluk halinin devamına ilişkin karara 22 Şubat’ta itiraz ettiği ve bunun değerlendirildiği belirtildi.

Atılı suçun yasada öngörülen ceza miktarı, ceza alması durumunda infaz yasasına göre cezaevinde kalması gereken ve tutuklulukta geçirdiği süre, suça konu delillerin büyük oranda toplanmış olması ve etki edebileceği bir delil bulunmamasının göz önüne alındığı belirtilen kararda, sanık Şansal’ın tutukluluk halinin devamına gerek bulunmadığının anlaşıldığı kaydedildi.

Mahkemenin kararında, itirazın kabulü ile sanık Şansal’ın CMK’nın 109/3-a maddesi uyarınca tahliyesine hükmedilirken, Şansal hakkında “yurt dışına çıkış yasağı”ndan oluşan adli kontrol tedbirinin uygulanması da karara bağlandı.
